The state Supreme Court has overturned the death penalty in the case of a man convicted in the drug-related shooting murder of his cousin

The state Supreme Court has overturned the death penalty in the case of a man convicted in the drug-related shooting murder of his cousin.
Derrick Harvey, 21, will undergo a new sentencing hearing after the court ruled that prosecutors had failed to establish that he killed Shawn Wilkins in January 1998 to promote his activities in selling drugs.
The reason was cited as an aggravating factor arguing for the execution of Harvey.
Harvey was convicted in October 1998 of killing Wilkins.
The court in a unanimous decision let stand Harvey's conviction on charges of 1st-degree murder.
