The state Supreme Court overturned the death sentence of Lionel Lewis Rogers, convicted of killing 80-year-old Hazel Sechler in 1997.
The ruling means will receive another sentencing hearing in which he could avoid the death penalty.The Supreme Court agreed that prosecutors acted improperly while questioning a psychiatrist testifying for defense during the sentencing phase of the trial.
Justice Bob Edmunds, writing for the court, said prosecutors' questions about Dr. Nathan Strahl's pay, his expertise and his background were improper.
Edmunds also chastised the Halifax County prosecutors for belittling Strahl's profession and distorting his testimony.
