The Supreme Court has affirmed the 25 counts of death penalty the Pasig City Regional Trial Court imposed on a man who raped his 13-year-old daughter in 1998, at the time his wife was pregnant with their fifth child.In a 32-page decision, the high court also ordered convict Severino Dulay to pay his daughter P1.375 million in total damages and indemnity. Dulay was accused of having unlawful sexual intercourse with his 13-year-old daughter by means of "force, threat and intimidation."In a related case, the SC also sentenced another rapist, Nicomedes Canon, to die by lethal injection. It affirmed the death sentence the Palawan RTC imposed on Canon for raping his nine-year-old daughter.Canon was caught by his wife in the act of raping the victim in the corn field near their house in Sitio Salvador, Barangay Dumarao, Roxas, Palawan on Jan. 22, 1996.In both cases, the SC said the respective death verdicts handed down by the trial courts were correct since under the Anti-Rape Law, the imposition of death sentence is warranted when the victim is under 18 years old and the offender is a parent.
