The Supreme Court in Abuja, Nigeria, upheld a death sentence passed on Andrew Nwachukwu in November 1999. Nwachukwu had been sentenced to death by a robbery tribunal in Imo for robbing one Canice Aguwa of two bags of crayfish valued at N1,050. The convict appealed against the judgement up to the Supreme Court which declared that he must die for the offence. Reading the unanimous Supreme Court ruling which upheld the Court of Appeal's decision, Justice Alfa Belgore, said Nwachukwu's appeal lacked merit. "Based on the totality of the evidence adduced at the trial and at the appellate court, it is our submission that the prosecution proved its case beyond all reasonable doubt against the appellant,' Belgore said in delivering a judgement endorsed by five justices of the Supreme Court.
