The Swaziland Court of Appeal ordered a retrial in the case of Bongani Mkhwanazi, a South African sentenced to death for murder. The presiding judges found that Swazi police had arrested Mkhwanazi in South Africa without following the correct channels. The court expressed concern at the conflicting versions regarding the circumstances surrounding the arrest and ruled that a retrial would assist in establishing the circumstances under which Mkhwanazi was arrested. Mkhwanazi was sentenced to death for killing Elliot Dlamini and attempting to murder Samuel Mgudeni Mabuza in 1998 in Ebenezer, Swaziland.
