The U.S. Fourth Circuit Court of Appeals has overturned the death sentence of Timothy Lanier Allen. Allen was sentenced to die for the 1985 slaying of Trooper Raymond Worley. In the 70-page ruling, the court found errors in the jury instruction during the sentencing phase of Allen's trial. A three-judge panel of the court had recommended overturning the sentence for Allen, who is black, after determining last year ( see February 5, 2003) that prosecutors tried to keep blacks off the jury. The full court did not accept that argument. Allen will be resentenced in Halifax County.
