The Zambian Supreme Court confirmed the death sentence imposed on a Congolese national for murdering two members of one family and staging three armed robberies in Mufulira in 1997.
Delivering judgement in the case of Zhya Mono, Justice Lombe Chibesakunda said the appeal against sentence and conviction was dismissed due to lack of merit.
Mono was convicted of murdering Gift Katai and Frank Chama. He was also found guilty of robbing Trust Kaita of several household goods valued at K1.5 million and then attempting to murder him, and robbing Willie Shimishi and Yolanti Zanu of assorted goods worth more than K1.5 million on separate dates.
The court arrived at its decision after analysing evidence on record and being satisfied that witnesses had properly identified Mono when the offence was committed.
In another case the court dismissed an application for a stay of the death sentence imposed on two men because the application was misconceived in law.
Benjamin Banda and Cephas Miti who were earlier sentenced to death had petitioned the High Court disputing the constitutionality of the death sentence, citing European authorities. The court said they were not appropriate to their case.
