three men of Luanshya walked to freedom after the Supreme Court quashed the death sentence slapped on them by the Ndola High Court in 2011.
Fredrick Chewe, 33, Keagan Chilufya, 24, and Willard Chisha,33, were overjoyed as they were led outside the court after Supreme Court judge Munyanda Wanki quashed their conviction and sentence. Judge read the judgement on behalf of acting chief justice Florence Mumba and judge Gregory Phiri during a Supreme Court sitting at the Kabwe High Court.
The court could not uphold the conviction and sentence of the three based on evidence of two witnesses which could not be relied upon.
The three were sentenced to death upon their conviction on one count of murder contrary to section 200 of the Penal Code Chapter 87 of the Laws of Zambia.
The three had been accused of murdering Abraham Mubanga of Ndola on unknown dates but between May 28 and June 6, 2011 in Luanshya.
They, however, appealed to the Supreme Court against the conviction and sentence.
Judge Wanki said the court could not uphold the conviction because the lower court excluded the dangers of relying on the evidence of two witnesses who were daughters of the deceased.
