Toh Su Kuan, a mechanic sentenced to death in 1998 for having 356 packets of heroin strapped to his torso and stuffed in his shoes was acquitted by the Court of Appeal on the basis that the prosecution had not proved that he had known what he was carrying.
In allowing the appeal, after hearing submissions by his counsel Karpal Singh and Deputy Public Prosecutor Abdul Wahab Mohamad, Judge Gopal Sri Ram said the prosecution had failed to prove the "vital ingredient" of Toh's possession of the dadah.
