Two American escapees recaptured in Geelong will not face the death penalty if they are extradited from Australia.
Mexican nationals Francisco Rios Balderrama and Armando Garcia Quiros are appealing in the Federal Court against a decision to extradite them to the US.
Commonwealth prosecutor Ray Plibersek said outside court, after a preliminary hearing of the case, that the US had given an undertaking the men would not face the death penalty.
Under Australian law, no person can be extradited if they would be subject to the death penalty in the country applying for their return.
The pair broke out of a Sydney correctional centre on September 11 and were recaptured in Geelong on October 1.
