a panel of three judges of the Court of Appeal unanimously ruled that the trial judge, Lugadya Atwooki, who presided over the High Court sitting in Mbale, Uganda, on November 11, 2002, had rightly sentenced Zubairi Waira, in his sixties, to death.
“We have no justification to fault the trial judge’s findings. In the result, this appeal lacks merit and it is hereby dismissed forthwith. We uphold the conviction and confirm the sentence of death,” the panel ruled. It was alleged that on June 11, 1999, Waira killed an infant boy in Pallisa whom his wife, Annet Magosi, had mothered with a previous husband.
