U.S. District Judge Anita B. Brody has overturned the death sentence imposed on Joseph Henry, convicted of raping and killing Jeanne Cleary 1986. U.S. District Judge Anita B. Brody ruled that the jury may have received improper instructions during the penalty phase of Henry's 1987 trial. The court ordered the state to hold another sentencing hearing within 180 days or sentence Henry to life imprisonment.
