A Morgan County jury recommended the death penalty for Marqueze Smith, 32, black. Smith was found guilty of Capital Murder last week in the Aug. 11, 2003 shooting death of Jeremy Black, 22. Judge Sherrie Paler will sentence Smith in August. Previously convicted of capital murder is Patrick Smith, the defendant’s uncle, and Christopher Smiley, who pleaded guilty to robbery in the case. Patrick Smith was tried and convicted of capital murder for Black’s death in 2008 and will stay in prison for the rest of his life. Smiley, negotiated a plea bargain with the district attorney in exchange for his testimony, and he pleaded guilty in 2009 to robbery. He is serving a 20-year prison sentence.
