A Morgan County jury today acquitted Daniel Wade Moore, 34, white, of all charges. Moore, a former death row inmate, was on trial for the 3rd time in the March 12, 1999 rape and killing of Karen Tipton, 39. Moore was convicted and sentenced to death at his 1st trial in 2003, but the judge, who had overruled the jury’s recommendation for a life sentence, later threw out the verdict because of misconduct by prosecutors, who had not disclosed an FBI report in the case. The 2nd trial ended in a mistrial last year with the jury deadlocked 8-4 for acquittal. Authorities testified that DNA found in a hair in the bedroom matched hair samples from Moore. Moore had been to the house around 6 months before to install an alarm while working for a security company. Moore attorney Jake Watson said the police work was really shoddy, and that he didn't know how his client's DNA wound up in the Tipton home but that authorities had not done a good job in collecting evidence. Moore is the 133rd person to be exonerated and freed from death row since 1973 (see also Jan. 1, 2003 and March 21, 2003).
