Mobile County Circuit Judge James Graddick upheld a jury’s recommendation last December, and sentenced Derrick Shawn Penn, 44, black, to death. A Mobile County jury found Derrick Penn guilty of four counts of capital murder for the May 27, 2009 fatally shooting of his estranged wife Janet Penn and beating her new boyfriend, Demetrius Powe.
