An Orange County jury has recommended the death penalty for Waymon Livingston, 29, black, convicted of raping and killing a woman, raping three others and assaulting another. A judge will sentence Livingston on April 26. The decision came two weeks after the jury found Livingston guilty of three counts of rape and one count of aggravated assault. The jury deadlocked on an additional count of rape involving another victim, and the judge declared a mistrial on that count. Livingston argued the sex was consensual. Livingston was first arrested on Oct. 11, 2007 by Anaheim police after forensic examiners analyzed evidence from three rapes and matched genetic material left at the crime scenes to him. He was later linked to the murder of Ana Gonzalez, 21, whose body was found in a motel in 2007.
