Superior Court Judge John Kavanewsky threw out the July 16, 2009 (see) death penalty verdict against Richard Roszkowski after admitting he made a mistake when he didn't tell the jurors they had to unanimously find there were no mitigating factors before deciding if Roszkowski should get the death penalty. However, the judge rejected a defense motion to immediately impose a life sentence on the 44-year-old Roszkowski. Instead, Kavanewsky ordered that the case continued for another jury to decide whether Roszkowski should be executed. The new trial will determine only if the death penalty should imposed; Roszkowski's guilt for the fatal shootings will not be changed. Roszkowski was sentenced  for the Sept. 7, 2006, shooting deaths of his former girl-friend Holly Flannery, 39, her daughter, Kylie, 9, and 38-year-old Thomas Gaudet.
