USA - Florida. Gregory K. Capehart, 43, black, sentenced to life

A Pasco County jury recommended Gregory K. Capehart, 43, black, serve life in prison. Pasco Circuit Judge Pat Siracusa agreed, sentencing Capehart to life. Capehart was sentenced to death in 1989 for the February 1988 rape and murder of Marlene Reeves, 62. But in 2004, Capehart was awarded a new penalty phase hearing after it was determined that he received poor legal representation in the penalty portion of his original trial. Capehart returned to court Tuesday for the new penalty phase; jurors deliberated for about 90 minutes before returning their recommendation for life. Much of the argument made by Capehart's attorney centered on his client's mental capabilities. 4 of 5 doctors who have evaluated Capehart over the past 20 years have found him to be mentally impaired, with an IQ of about 70.
