USA - Florida. Judge Linda Nobles sentenced Timothy Hurst, 32, to death

Circuit Judge Linda Nobles sentenced Timothy Hurst, 32, to death. He was convicted in April 2000 of 1st-degree murder in the May 2, 1998 killing of 28-year-old Cynthia Harrison during a robbery. This is the 2nd time Hurst has been sentenced to death. In 2000, a jury decided 11-1 that he deserved the death penalty. Former Circuit Judge Joseph Tarbuck initially sentenced him to death. However, that sentence was overturned by the Florida Supreme Court on Sept. 17, 2009 (see) because certain pieces of evidence, including those that established Hurst's mental capacity, were not shown to the jury during the penalty phase. A new penalty phase was held last year, and the jury decided 7-5 to recommend the death penalty.
