USA - Florida. The Florida Supreme Court reversed the death sentence of Rafael Andres

The Florida Supreme Court ruled that the death sentence imposed by a trial judge on Rafael Andres following a 9-3 jury recommendation for death violated its ruling in Hurst v. State that non-unanimous death verdicts violate the Sixth Amendment and the Florida state constitution. The court upheld Grant's conviction. Miami-Dade Circuit Judge Dava Tunis sentenced Rafael Andres, 54, Hispanic, to death on May 6, 2915 (see) for the January 2005 murder of 31-year-old Yvette Farinas. A jury convicted Andres of first-degree murder and other felonies. The jurors, by a 9-3 vote, recommended the death penalty.
