A Jo Daviess County jury sentenced David Damm to die.  Damm, 60, was found guilt of 1st degree murder, conspiracy to commit murder, and aggravated kidnapping for hiring Bruce Burt to drive Donnisha Hill out of the neigborhood and murder her on Oct. 27, 2006. A few weeks earlier, the 13-year-old had produced a paper towel containing Damm's semen and said her neighbor had been sexually abusing her for some time. Judge William Kelly scheduled Damm's execution for Dec. 1, but an appeal is automatic. Additionally, Illinois has issued a moratorium on executions, and until the governor overturns that decision, nobody on death row can be executed. Burt testified for the state as part of a plea agreement that kept him off death row.
