U.S. District Judge Allen Pepper Jr. said William L. Wiley is mentally retarded and therefore can't be executed. Judge Pepper said he would vacate Wiley's death sentence if the state doesn't respond within 60 days. Wiley, 55, originally was sentenced to death in DeSoto County Circuit Court after admitting the Aug. 22, 1981 killing of convenience store owner J.B. Turner in a robbery.
