The Mississippi Supreme Court has thrown out the death sentence given to Kristi Fulgham for her role in the May 2003 murder of her husband. In an unanimous decision, the court ordered a new sentencing hearing, ruling the trial judge erred in disallowing testimony of a social worker called during the sentencing phase of Fulgham's trial. The Supreme Court upheld Fulgham's capital murder conviction in the shooting death of Joseph "Joey" Fulgham, at the couple's home. In July 2003, an Oktibbeha County grand jury indicted her and her half-brother, Tyler Edmonds, then 14, for the death. Edmonds was convicted and sentenced to life in prison without parole in 2004, but later was freed after a new trial. Fulgham was sentenced to death on December 9, 2006 (see)  in Oktibbeha County. Prosecutors said Joey Fulgham was shot once in the head while he slept in his home.
