USA - Missouri. The Missouri Supreme Court has overturned the death sentence of Marvin Rice

The Missouri Supreme Court has overturned the death sentence imposed on Marvin Rice by a St. Charles County judge under the Missouri "hung jury" sentencing law after the jury had voted 11-1 in favor of life sentence. The appeals court did not reach the constitutionality of the statute's judge-sentencing provision, instead granting a new sentencing hearing as a result of prosecutorial misconduct for commenting on Rice's exercise of his right not to testify in the case.
