A Hamilton County jury has unanimously recommended the death penalty for Rayshawn Johnson, 33, black, for the Nov. 12, 1997, baseball bat beating murder of Shanon Marks, 29, in her home. Johnson was originally given the death penalty in 1998, but on Oct. 10, 2010 the 6th U.S. Circuit Court of Appeals ordered a new sentencing, saying that he had received inadequate counsel during his original trial because his lawyers didn't fully investigate his abusive childhood. The final sentence will come from Judge Ralph Winkler.
