USA - Ohio. Judge again sentences Donna Roberts to death.

Donna Roberts, 69, White, has been re-sentenced to the death penalty for her role in the December 11, 2001 murder of her ex-husband, Robert Fingerhut to collect insurance money. Roberts and her boyfriend, Nathaniel Jackson, were first sentenced to death on June 20, 2003 (see). On August 2, 2006 (see) the Ohio Supreme Court unanimously threw out the sentences of both because the trial judge had allowed a prosecutor to be involved in preparing his opinion. A Trumbull County sentenced her again to death in 2007, and a judge upheld the sentence on December 29, 2008. Jackson has also been resentenced to death on August 14, 2012 (see). On October 22, 2013 (see) the Ohio Supreme Court for 2nd time rejected the sentence of Roberts. The court's 5-2 decision found that a judge failed to consider evidence arguing against a death sentence, including indications that brain trauma from several traffic accidents had affected Roberts' mental health. Other evidence included Roberts' childhood in an abusive home and evidence of good deeds as an adult, such as raising money for wounded soldiers in Israel. Judge Ronald Rice conducted a sentencing hearing today in Trumbull County Common Pleas Court and gave another death sentence.
