Ohio Supreme Court for 2nd time rejects sentence of Donna Roberts, 69, White, the state's only female death row prisoner. The court's 5-2 decision in the case of Roberts found that a judge failed to consider evidence arguing against a death sentence, including indications that brain trauma from several traffic accidents had affected Roberts' mental health. Other evidence included Roberts' childhood in an abusive home and evidence of good deeds as an adult, such as raising money for wounded soldiers in Israel. The court's ruling ordered a judge to resentence Roberts for the December 11, 2001 murder of her former husband, Robert Fingerhut. Roberts' 1st death sentence was overturned on August 2, 2006 (see) following the discovery of a prosecutor's involvement in writing Roberts' sentencing order. (see also June 20, 2003).
