The U.S. Court of Appeals for the 10th Circuit has overturned the death sentence imposed on James Pavatt, 63, White. The court ruled that the state courts had applied the aggravating circumstance that the murder had been committed in "an especially heinous, atrocious, and cruel" manner in an unconstitutionally broad manner in his case.
