A Marion County judge overturned the death sentence of Jesse Fanus, 32, white. Fanus was convicted of gunning down Marion Carl on June 28, 1998. The young man stole cash and a car in the break-in. Fanus was the youngest person on Oregon’s death row when he was sentenced to death in 1999 at age 19. The judge said that the defense attorney failed to adequately represent Fanus during the 1999 trial, because he didn’t disclose to the jury that Fanus had been abused as a child.
