Marion County Circuit Judge Don Dickey has ordered a new trial for Martin Allen Johnson, 56, white, convicted in the Feb. 23, 1998 killing of Heather Fraser, 15, white. Johnson was convicted in 2001 of drugging, raping and strangling Fraser and then throwing her body into the Columbia River. Judge Dickey heard Johnson's post-conviction relief case last June and after taking the case under advisement in November, granted the inmate's petition last week. Johnson's lawyers did not adequately defend him in his Washington County Circuit Court aggravated murder trial, Dickey wrote in his decision.
