Judge John Tylwalk has ruled that Freeman May is incapacitated and incompetent to be executed. May, now 56, White, was convicted of the 1982 stabbing death of Kathy Lynn Fair, 22, whose remains were found 6 years later in woods in Lebanon County. He was sentenced to death in 1991. The sentence was reversed but reinstated after a second penalty phase hearing in 1995. The state Supreme Court again vacated the death sentence on May 26, 2006 (see), but it was reinstated by a jury on October 16, 2008 (see) following a third penalty phase hearing. May is the father of Landon D. May, who was convicted of first-degree murder on Jan. 9, 2003 (see) for the torture and killing of Lucy and Terry Smith.
