USA - Texas. Court of Appeals for the Fifth Circuit again denied relief to Obie Weathers

After being reversed by the U.S. Supreme Court in October 2017 for applying an unconstitutional standard (on September 12, 2016) in rejecting Texas death-row prisoner, Obie Weathers's claim that he is ineligible for the death penalty, the United States Court of Appeals for the Fifth Circuit has again denied relief to Weathers. The circuit court ruled that that Moore v. Texas, which declared the Texas standard unconstitutional, does not apply retroactively. Weathers, 37, Black, was sentenced to death in Bexar County on Sept. 13, 2001 in the Feb. 4, 2000 robbery and murder of Ted Church, 63, a bartender.
