Governor Rick Perry signed SB 1292, which provides that the prosecution can ask for the death penalty in a trial only after you have had positive feedback from a DNA test carried out during the investigation. The law was passed May 27, 2013 in both the House and the Senate , in both cases with a unanimous vote .Obviously the law, which will come into force on September 1, 2013, applies only to those cases where DNA tests are possible, ie where there are physiological findings . The bill was introduced by Democratic Senator Rodney Ellis in agreement with the Attorney General Greg Abbott, and obliges the state to pay for the tests in all cases where it is possible to do so . Senator Ellis summed up the spirit of the bill : " We know that sometimes we do not take the right person. We must be sure not to send an innocent man on death row , and above all we must avoid the specter that an innocent person could be put to death".
