Michael Toney, Recently Exonerated from Death Row in Texas, Dies in Car Crash. Michael Roy Toney, who recently became the 136th person exonerated and freed from death row since 1973, died in a car crash on October 3 in Texas. Toney, 43, white, died in an 11 a.m. crash in Cherokee County when his truck veered off Farm Road 347, overturned and ejected and crushed Toney. Toney had spent almost 10 years on death row for the 1985 bombing deaths of 3 people in a trailer. The Texas Court of Criminal Appeals ruled on December 17, 2008 that the prosecutor withheld evidence that might have helped Toney at his 1999 trial. He had been released from jail on September 2 after the state dropped all charges against him for a 1985 bombing that killed three people.
