Washington forbids the execution of the mentally retarded and juvenile offenders. The state has life without parole. A jury decides the sentence. The Governor has the power to commute death sentences to life imprisonment and hard labor upon such conditions and restrictions as the Governor thinks proper. Washington is one of only two states (the other being Delaware) to have carried out execution by hanging since the death penalty was reintroduced.
