ZAMBIA. MAN TO HANG FOR ROBBERY
the Ndola High Court, Zambia, sentenced Emmanuel Mulenga. a 31-year-old man. to death by hanging for aggravated robbery. Passing sentence, Judge Muyinda Wanki said the offence was especially serious due to the use of a firearm.

He said the offence carried only one sentence under the law and that passing a different sentence would be illegal.
"I have heard the mitigation but the offence committed only carries one sentence once found guilty, and I therefore convict you to death by hanging by the neck until pronounced dead," Judge Wanki said.
Evidence before the court was that Mulenga, together with three accomplices, broke into the house of Peter Kaluba in Twapia on February 8, 2004 and stole property worth over K8 million. The court heard that the three had masks on their faces but Mulenga did not, and it was he who had a firearm which he used to fire in the air to scare Kaluba's two children prior to leaving their home. The children also identified Mulenga at an identification parade. They told the court that they could not mistake Mulenga because the lights were on at the time the four broke into their house.
