Alabama does allow the execution of juvenile offenders from 16 years onwards but does have life without parole. Sentencing is decided by a judge, who can override the jury's recommendation.
Together with Florida, Alabama is the only state which, following the Ring v. Arizona ruling, allows a judge to go against rulings made by the jury.
A 2001 law set up a committee for the reimbursement of those wrongly sentenced to death.
The Governor has sole authority to grant reprieves and commutations in capital cases. Sentences that are commuted to life are not eligible for a pardon from the Board of Pardons and Paroles unless the Board receives sufficient evidence to indicate that the person is innocent of the crime of conviction and unanimously approves the pardon with the Governor.
On April 25, 2002 Governor Don Siegelman signed a lethal injection measure into law. Alabama will begin using lethal injection July 1.
