An accused cannot be condemned only on the basis of circumstantial evidence, the Orissa High Court ruled.
The ruling was given by the court recently while quashing a death sentence given by a trial court to a person convicted of murdering his wife. The circumstances relied upon to convict an accused must be fully established and the chain of evidence furnished to those circumstances must be so complete as not to leave any reasonable doubt for a conclusion consistent with the innocence of the accused, the Division Bench observed.
