Frank Lee Smith, who had been convicted of a 1985 rape and murder of an 8-year-old girl, and who died of cancer 11 months ago while still on death row, was cleared of these charges according to an aide to Florida Gov. Jeb Bush. Smith had been scheduled for execution in 1990, but received a stay. The Governor is planning similar tests for other condemned inmates. Smith was the 20th death row inmate who has been exonerated in Florida since 1973 - more than any other state. For every five inmates executed in Florida, two other death row inmates have been exonerated.
