In a 6-3 ruling, the Texas Court of Criminal Appeals reduced the capital murder conviction and overturned the death sentence for John Milton Herrin, who had been on death row since August 2000. The man should have been convicted of the lesser crime of murder and ordered that he be resentenced.
The maximum penalty for murder is life in prison.
Herrin was convicted for killing Kenneth Wayne Martindale.
