In Cincinnati, The 6th U.S. Circuit Court of Appeals ordered a man sentenced to death for a slaying to be resentenced, ruling that he received inadequate legal representation at his original hearing. The court ruled 2-1 that David Hamblin's trial lawyer did not make a reasonable effort to obtain and present evidence that could have persuaded the jury not to recommend execution. Their ruling gives the state 6 months to either conduct a new sentencing hearing for Hamblin, or appeal further. A jury in Cuyahoga County Common Pleas Court convicted Hamblin of killing Lillian Merrick. Hamblin, now, 52, was given the death sentence in 1984 for his aggravated murder conviction.
