It is surprising that lawyers have suggested to the government to "use other methods of executing inmates on death row because the present method of hanging is inhuman".
The law of natural reason postulates that there is no method of killing a person that is human. Life is the greatest gift to humankind, the mother of all human rights since no other human right can exist if the right to life is taken away".
Therefore, by deduction, no person has the right to take away another person's life. By induction, capital punishment leads to a dilemma because no human person is able to give back life once it is taken away. Experience has shown that judges are not always right. There can be human error. Col. Kiiza Besigye went to court against President Museveni. Out of five judges, two were for Besigye and three for Museveni.
Ssemogerere of DP went to court challenging the last referendum. The judges of the court of appeal nullified the referendum and the judges of the Supreme Court validated it. The two groups of judges, cannot be correct on different issues at the same time.
Yet these are the judges who sentence people to death! Supposing after the death of a person, it is discovered that there was an error in judgement, what happens?
Natural logic dictates that such a judge should get the same sentence, a scenario that leads to a vicious circle.
The death sentence is often politicised. Apart from murder, defilement, rape and aggravated robbery, in Uganda one is sentenced to death if one is guilty of treason. The paradox here is that a guerrilla today is a liberator tomorrow. That the president, who may not even be a lawyer, determines who should die and who should wait is a gimmick. The prerogative of mercy by the president is also a political circus.
What criterion was used to determine that Hajji Musa Sebirumbi and 18 others should die while Nassur Abdallah should be pardoned and released when the judge condemned all to death?
Capital punishment is contradictory because punishment should be rehabilitative and a deterrent but they cannot be done on a dead person. The death penalty is not a deterrent, otherwise the public firing squads of Idi Amin should have scared Museveni and his colleagues to denounce rebellion. But did it?. How about the innocent wife who is widowed and whose innocent children are orphaned?
