Specialists in criminal and constitutional law say: chances slim for Abu-Jamal retrial. A ruling overturning his death sentence but affirming his murder conviction means an appeal would face tough odds, they say. A new trial for Mumia Abu-Jamal is less likely than ever after court decision upholding his murder conviction, legal experts say. While U.S. District Judge William H. Yohn Jr. overturned Abu-Jamal's death sentence, he upheld the facts used to prove that he killed Philadelphia Police Officer Daniel Faulkner. That partial victory is probably the best the defence can expect.
