Perry, 37, killed John Wallis Johnston, 74, on Feb. 21, 1997. Physical evidence at the scene linked Perry to the slaying and a jury found him guilty in 1999 and sentenced him to death.
The Florida Supreme Court overturned the original sentence in 2001, ruling that Circuit Judge Joseph Tarbuck erred when he allowed Perry's ex-wife to testify about Perry's violent nature.
On Monday Circuit Judge Linda Nobles will decide whether to accept the jury's recommendation.
