A man with a lengthy criminal record was sent to death row a 2nd time for the 1980 slaying of a grocery clerk. Bobby James Moore, now 41, was 1st sentenced 21 years ago for the shotgun killing of James "Jim" McCarble, 72. But an appeals court ruled in 1999 that Moore had ineffective counsel because the original jury was never told during his trial's punishment phase that he claimed the shooting was an accident. A new jury was instated to hear only that portion of the trial and decide whether to commute Moore's sentence to life or return him to death row. After almost two days of deliberation, the panel voted for the death penalty. McCarble was killed April 25, 1980, when Moore and 2 accomplices robbed Birdsall Super Market near Memorial Park.
