According to lawyers acting for President Thabo Mbeki, South African courts have no power to order the government to request that an alleged Muslim bomber on trial in the United States not be given a death sentence. In papers filed in the Cape High Court this week, they said this would infringe the separation of powers between the executive and the judiciary.
