An advisor to the Yugoslav justice minister, Goran Tokic, said that the new Yugoslav Penal Code envisages the possible extradition of Yugoslav and foreign citizens to an international tribunal, which Yugoslavia has agreed to recognize.
The federal parliament adopted the Roman Statute of the International Tribunal [in The Hague] in June.
Tokic explained that extradition of Yugoslav and foreign citizens concerned those charged with the criminal acts of genocide, war crimes and crimes against humanity, committed after the law comes into effect.
The Serbian and Montenegrin Justice Ministries and the Federal Foreign Ministry will no longer decide on extradition, in order to make this process more efficient. Permission for extradition will be issued by the Yugoslav Justice Ministry.
The Yugoslav justice minister will not be able to allow extradition in case there is a possibility that the extradited person be sentenced to death, given that this punishment has been abolished in Yugoslavia, in line with the Council of Europe's advice, Tokic said.
