Florida does not forbid the execution of juvenile offenders from the age of 17.
In June 2001 Governor Jeb Bush approved a law that bans the death penalty for the mentally retarded. Florida has the sentencing option of life without parole.
Together with Florida, Alabama is the only state which, following the Ring v. Arizona ruling, allows a judge to go against rulings made by the jury.
The Governor has the authority to grant clemency on the advice of the Board of Executive Clemency. However, the Governor has the absolute power to sign the death warrant. The Governor also has the power to grant reprieves of up to sixty days by executive order.
In 2000, a law was approved introducing lethal injection and another that limits death row inmates appealing on legal technicalities to two appeals in state courts and requires second appeals be filed within six months of the first.
