In Talladega, the same jury that convicted Jimmy Lee Brooks Jr. of capital murder in the killing of a 12-year-old boy has unanimously recommended today that he be sentenced to death. Brooks, 25, was convicted Monday in the Feb. 17, 2002, murder of Brett Bowyer and attempted murder of Brett's father, who survived a cut to his throat and being buried alive with his son's body in a makeshift grave. Co-defendant Michael David Carruth, 45, was convicted of capital murder in October and sentenced to death, a penalty with an automatic appeal. Brooks' trial was moved to Talladega County because of publicity. The boy's father, Forest "Butch" Bowyer, testified that Brooks and Carruth robbed him at his Phenix City home before taking him and his son to an isolated area where they slit his throat, shot his son and threw them both in the shallow grave. Brooks was also convicted of burglary and robbery in the 1st degree.
