Indiana forbids the execution of the mentally retarded and since March 2002 the execution of juvenile offenders. The state has life without parole. Sentencing is decided by a judge, who can override the jury's recommendation. The Governor on the advice of the Parole Board has the power to grant clemency. The Governor needs a favorable recommendation of the Board to be able to grant clemency. The Governor, however, is not bound by the favorable recommendation.
